How to Protect Yourself: Lien Waivers


A lien waiver is a document in which a contractor or supplier gives up their right to file a lien upon receipt of payment. There are two types:


Conditional waiver: "I waive my lien rights if and when I receive payment." Exchange at payment time.


Unconditional waiver: "I have been paid and waive my lien rights." Get this after payment clears.


What to Request on Every Project


For projects over $10,000, request:

  • A sworn statement from the GC listing all subcontractors and suppliers
  • Conditional lien waivers from each sub and supplier at each payment milestone
  • Unconditional lien waivers at project completion

    Texas Two-Month Lien Filing Deadline

    Title Company Process


    When you refinance or sell a home after major work, the title company typically requires lien waivers or affidavits from the GC. Addressing this during the project is far easier than after the fact.
